Organisational Overview
The Office of the Public Guardian (OPG) protects people in England and Wales who may not have the mental capacity to make certain decisions for themselves, such as about their health and finance. We are an Executive Agency of the Ministry of Justice (MoJ), set up in 2007 following the introduction of the Mental Capacity Act of 2005.
OPG is responsible for registering lasting powers of attorney (LPA) and enduring powers of attorney (EPA) and supervising deputies who are appointed by the Court of Protection.

Team Overview

Successful candidates will join the Supervision and Investigations Service (SIS) within the Operations Directorate. Our vision is for the Office of the Public Guardian to strengthen supported decision making. We encourage freedom of decisions for all who can make decisions, giving support as required, and provide protection for those who cannot. Our mission within SIS is to uphold the principles of the Mental Capacity Act in England and Wales by supervising deputies appointed by the Court of Protection and making sure they carry out their legal duties in line with the PG’s statutory function; we also investigate concerns about abuse by deputies.
Duties and Responsibilities
• Manage a caseload of complex cases or an investigation, making the best use of available time and resources to ensure you meet performance expectations.
• Regularly monitor performance against key milestones and act promptly to reassess workloads and priorities when there are conflicting demands to maintain performance.
• Work closely with colleagues to resolve problems quickly and improve performance, using management information and feedback from Deputies and third parties; analyse performance and ensure a professional and responsive approach to the supervision and investigation of deputies, remaining alert to emerging issues and trends which might impact your work area.
• Contribute and participate at local management meetings and business level forums. Proactively lead and participate in relevant working groups and committees. Liaise and collaborate with colleagues to ensure that work is effectively managed and to foster effective working relationships
• Refer to Legal and Policy for advice and guidance as appropriate and ensure you comply with their input.
• Produce witness statements as required and, rarely, attend Court.
Agreed Expectations
The successful candidate will be expected to work from their base location on a weekly basis in line with current Civil Service requirements, outside of any reasonable adjustments.
We encourage a hybrid way of working which includes some remote/home working alongside office working.
This is subject to business needs and satisfactory performance. All new starters are able to work from home once your line manager has signed this off. This is pro rata for part time staff.
All new starters in the Nottingham Supervision team are required to attend the office full time (37 hours per week) during the first 3 weeks of technical training. Following those initial weeks you are expected to continue your training and consolidation in the office but any agreements for part time working can commence.
We require part time staff to commit to at least 22:12 working hours over 3 days per week as a minimum.
Skills & Qualifications
Essential Skills
• Strong written, telephone and oral communication skills.
• A self-starter able to work on their own initiative, managing competing priorities in a fast paced and challenging environment
• Ability to manage and resolve complex cases or investigations, through the analysis of multiple sources of information.
• Ability to work with colleagues within your own team and those from other parts of the OPG, as well as external stakeholders
• Proficient in the use of standard Microsoft office products.
Desirable Skills
• Knowledge of the MCA and Code of Practice leading to an understanding of the impact of Court of Protection, legal and policy decisions and how to operationalise them.
• Ability to lead and motivate teams with a focus on successful change management, and the embedding of excellent customer service.

Working Arrangements & Further Information
The MoJ offers Hybrid Working arrangements where business need allows. This is an informal, non-contractual form of flexible working that blends working from your base location, different MoJ sites and / or from home (please be aware that this role can only be worked in the UK and not overseas). All employees will be expected to spend a minimum of 60% of their working time in an office, subject to local estate capacity.
Some roles will not be suitable for Hybrid Working. Similarly, Hybrid Working will not suit everyone’s circumstances. Arrangements will be discussed and agreed with the successful candidate(s) and subject to regular review.
For nationally advertised role: all successful candidates will be appointed to the nearest viable office nearest to their home postcode and on its respective pay scale. This will be at either a HQ building (subject to desk allocation, a Justice Collaboration Centre (JCC) or a Justice Satellite Office (JSO) – See Map. All employees will be expected to spend a minimum of 60% of their working time in an office, subject to local estate capacity).
For current MoJ employees, your base location will need to be changed to the nearest viable office (to your home postcode), either at a HQ building, JCC or JSO within the National Office Network and moved its location’s respective pay scale (any legacy arrangements/locations will need to be amended).
Some of MoJ’s terms and conditions of service are changing as part of Civil Service reform. The changes will apply to staff joining MoJ who are new to the Civil Service. Staff joining MoJ from other civil service employers will transfer onto the new MoJ terms if they are already on 'modernised' terms in their current post or onto 'unmodernised' MoJ terms if they are on 'unmodernised' terms at their current post. Details will be available if an offer is made.
MoJ candidates who are on a specialist grade, will be able to retain their grade on lateral transfer.
All candidates who are currently in receipt of Mark Time / Pay Protection should ensure they are familiar with the new policy on permanent and temporary promotion which can be found on the employee intranet.
Flexible working hours
The Ministry of Justice offers a flexible working system in many offices. Standard full time working hours are 37 hours per week. MoJ welcomes part-time, flexible and job-sharing working patterns, where they meet the demands of the role and business needs. Annual Leave
Annual leave is 25 days on appointment and will increase to 30 days after five years’ service.
