Overview of the job

The Foreign National Offender Policy and Cross Border Transfer team is placed within Interventions and Operational Services of the Central Operational Services Directorate. The post is based in HQ and located in 1 Ruskin Square, Dingwall Road, Croydon, CR0 2WF.

The job holder will be a member of a small team responsible for case working international prisoner transfers, and intra-UK prisoner transfer requests, including transfer requests for cross border court proceedings.

The job holder reports to the Casework Manager.

Summary

The removal of foreign national offenders from the United Kingdom at the earliest opportunity is a key cross-Government priority. HMPPS has a crucial role to play in delivering this policy objective and is held accountable for its delivery by Ministers, Parliament and the media.

The job holder is responsible for case working applications for prisoner transfer into and out of England and Wales or to international jurisdictions. Applications for transfer may be made by prisoners or by official bodies such as the police and the Crown Prosecution Service. The job holder is responsible for obtaining and collating required documentation; considering each application on its individual merits, and for submitting reasoned recommendations for action to the Casework Manager. The job holder is responsible for putting in place arrangements for the physical transfer of a prisoner and resolving any difficulties that may arise.

The job holder is responsible for maintaining and developing relationships with officials in other jurisdictions, including officials in foreign governments.

Responsibilities, Activities and Duties

The job holder will be required to carry out the following responsibilities, activities and duties:

To consider applications from prisoners who wish to be repatriated to and from England and Wales and another international jurisdiction and to make reasoned recommendations for action to the Casework Manager in accordance with the relevant criteria for transfer, and the application of the European Convention on Human Rights. All actions to be taken within time scales set by the Head of Casework.

To consider applications from prisoners who wish to be transferred to and from England and Wales and another UK jurisdiction or the Islands. All applications to be considered against published criteria for transfer announced in Parliament. The job holder will make reasoned recommendations to the Casework Manager on appropriate action. To support the Head of Casework in the consideration of applications for the transfer of a prisoner from British Overseas Territories to England and Wales under the Colonial Prisoners Removal Act 1883.

To support the Head of Casework in the consideration of applications for transfer from International Criminal Courts and Tribunals, liaising with relevant Government Departments, prisons and the International courts in relation to the logistical transfer of prisoners.

To consider, determine, and take appropriate action in relation to transfer of prisoners to and from England and Wales and other UK jurisdictions or the Islands for the purpose of court productions, police productions, funeral escorts or other exceptional compassionate transfers.

To put in place all appropriate arrangements necessary to repatriate or transfer a prisoners once authority has been given by the Casework Manager; liaising where necessary with the other relevant authorities, prisons, courts, police, Home Office Immigration Enforcement and escort services. All actions to be taken within agreed timescales.

To prepare all appropriate warrants necessary to authorise transfer, obtain signature of warrants, and to distribute the warrant to those parties that require them.

Notify all relevant authorities once transfer or repatriation has taken place, including the police, and ensure that all records are updated accordingly.

To liaise with relevant prisons, HMPPS departments, the Home Office, and NCA to ensure the transfer of prisoners who are subject to transfer under Mutual Legal Assistance legislation or extradition matters. Ensuring that prison governors are aware of the transfer and of their legal obligations.

To ensure that the Cross Border Transfer database is kept up to date and that all appropriate data is inputted. Maintain casework files to the satisfaction of the Head of Section, ensuring that all documentation is identified and indexed. All files and data to be maintained and handled in accordance with the requirements of the Data Protection Act.

To prepare appropriate replies to correspondence from prisoners, their family members, their legal advisers, other UK Government Departments and foreign Governments, ensuring that the reply is issued within departmental guidelines for responding to correspondence.

To prepare quarterly invoices for the recovery of costs in relation to prisoners held on behalf of Crown Dependencies and British Overseas Territories.

The duties/responsibilities listed above describe the post as it is at present and is not intended to be exhaustive. An ability to fulfil all spoken aspects of the role with confidence through the medium of English or (where specified in Wales) Welsh.

Working Arrangements & Further Information

The MoJ offers Hybrid Working arrangements where business need allows. This is an informal, non-contractual form of flexible working that blends working from your base location, different MoJ sites and / or from home (please be aware that this role can only be worked in the UK and not overseas). Some roles will not be suitable for Hybrid Working. Similarly, Hybrid Working will not suit everyone’s circumstances. Arrangements will be discussed and agreed with the successful candidate(s) and subject to regular review.

For nationally advertised roles, the successful candidate(s) will be appointed to a MoJ office location, which may include their nearest Justice Collaboration Centre or Justice Satellite Office. This will be discussed and agreed on the completion of pre-employment checks.

Some of MoJ’s terms and conditions of service are changing as part of Civil Service reform. The changes will apply to staff joining MoJ who are new to the Civil Service. Staff joining MoJ from other civil service employers will transfer onto the new MoJ terms if they are already on 'modernised' terms in their current post or onto 'unmodernised' MoJ terms if they are on 'unmodernised' terms at their current post. Details will be available if an offer is made.

Standard full time working hours are 37 hours per week excluding breaks which are unpaid. HMPPS welcomes part-time, flexible and job-sharing working patterns, where they meet the demands of the role and business needs. All applications for part-time, flexible and job-sharing working patterns will be considered in accordance with the HMPPS’ Flexible Working policy.
