Job description - overview
This is an exciting opportunity for a lawyer to work directly with the Senior President of Tribunals and other members of the senior judiciary.

The SPT is the head of the tribunals judiciary. He provides leadership to the judges and members of the First-tier Tribunal, Upper Tribunal, Employment Tribunals and Employment Appeal Tribunal – in all, around 5000 judicial office-holders.

The SPT has a number of statutory responsibilities. These include representing the views of the tribunals judiciary to the Lord Chancellor, parliament and ministers, and maintaining arrangements for the training, guidance and welfare of tribunal judges and members.

The unified tribunals system in England and Wales was created separately from the structure of the courts and has different statutory underpinnings. In recent years the senior judiciary in England and Wales has sought to build stronger links between the courts and tribunals judiciaries. Further work is underway to create a unified statutory leadership structure which will unite the tribunals in England and Wales with the courts of that jurisdiction under the leadership of the Lady Chief Justice of England and Wales. This will entail changing the office of Senior President of Tribunals and will require primary legislation. It is envisaged that the SPT will continue to lead the tribunals, with a role equivalent to that of a Head of Division of the High Court. As the SPT’s lawyer you will assist in this important project and will work with other lawyers in the Judicial Office and in the Ministry of Justice to bring it to fruition.

This is a high-profile role for a lawyer and offers the opportunity to become a recognised and respected voice at the heart of the justice system. You will need to be confident in advising all of the senior judges with responsibility for administrative justice, including the SPT and his deputy, as well as the presidents of the chambers in the First-tier and Upper Tribunals and of the Employment Tribunal and Employment Appeal Tribunal.

You will have a large degree of autonomy in undertaking your work and will need to be able to work independently to provide high quality legal, strategic and policy advice to the senior judiciary. You will also need to be able to form strong working relationships with members of the judiciary (at all levels), with the lawyers in other senior judges’ private offices, and with a wide range of key officials across the civil and administrative justice systems.

You will be an essential member of the SPT’s busy private office team. You will work closely with his Private Secretary to support the SPT in fulfilling his statutory responsibilities. Part of the enjoyment and challenge of working within a private office is that work can be fast paced and unpredictable, particularly during the judicial termtime. There may be opportunities for travel, both within the UK and internationally, supporting and participating in judicial engagements such as conferences and court visits.

Job description – specific responsibilities
Specific responsibilities will include:

•    Advising the Senior President of Tribunals on his statutory responsibilities under the Tribunals, Courts and Enforcement Act 2007 and other legislation;
•    Advising the SPT in relation to the duties delegated to him by the Lady Chief Justice;
•    Conducting legal research and assisting with the SPT’s preparation of lectures, speeches, and articles on both legal and policy matters;
•    Acting as the SPT’s private office’s representative at meetings of the Tribunal Procedure Committee;
•    Advising the SPT on the development of the digital justice system, in particular supporting his membership of the Online Procedure Rules Committee;
•    Advising the Judicial Office’s Strategy and Modernisation Team on projects relating to the tribunals, including changes to judicial working practices and legislation to reform the role of the SPT;
•    Deputising for the Private Secretary to the SPT on occasion;
•    Supporting other members of the Judicial Office legal team, collaborating on questions on complex or cross-cutting legal issues.

Qualifications and experience
The successful applicant must:

•    Be qualified to practice as a solicitor or barrister in England and Wales and hold a valid practising certificate (if required) or be able to obtain one;
•    Be able to provide high quality legal advice (both written and oral) which fits into the wider policy and operational context.

Desirable experience includes:

•    Experience of equality law as it applies in England and Wales.

Selection criteria
Technical legal skills
The successful candidate will be required to provide evidence of:
•    A good understanding of public law principles and constitutional law;
•    Knowledge of tribunals procedure;
•    Sound analysis, using legal research to produce timely and fit for purpose advice;
•    An ability to communicate advice effectively both in writing and orally, with little formal legal supervision;
•    Reliable legal judgment and appreciation of legal risk, being able to identify and explain legal options, giving a steer as appropriate, and extracting key legal issues;
•    An understanding of the role of an advisory lawyer.

Should we receive a large number of applications we will sift primarily on the lead behaviour of communicating and influencing. Successful applicants will then be invited to an interview. Working Arrangements & Further Information

The MoJ offers Hybrid Working arrangements where business need allows. This is an informal, non-contractual form of flexible working that blends working from your base location, different MoJ sites and / or from home (please be aware that this role can only be worked in the UK and not overseas). All employees will be expected to spend a minimum of 60% of their working time in an office, subject to local estate capacity.

Some roles will not be suitable for Hybrid Working. Similarly, Hybrid Working will not suit everyone’s circumstances. Arrangements will be discussed and agreed with the successful candidate(s) and subject to regular review.

For nationally advertised role: all successful candidates will be appointed to the nearest viable office nearest to their home postcode and on its respective pay scale.  This will be at either a HQ building (subject to desk allocation, a Justice Collaboration Centre (JCC) or a Justice Satellite Office (JSO) – See Map. All employees will be expected to spend a minimum of 60% of their working time in an office, subject to local estate capacity). 

For current MoJ employees, your base location will need to be changed to the nearest viable office (to your home postcode), either at a HQ building, JCC or JSO within the National Office Network and moved its location’s respective pay scale (any legacy arrangements/locations will need to be amended).

Some of MoJ’s terms and conditions of service are changing as part of Civil Service reform. The changes will apply to staff joining MoJ who are new to the Civil Service. Staff joining MoJ from other civil service employers will transfer onto the new MoJ terms if they are already on 'modernised' terms in their current post or onto 'unmodernised' MoJ terms if they are on 'unmodernised' terms at their current post. Details will be available if an offer is made.

MoJ candidates who are on a specialist grade, will be able to retain their grade on lateral transfer.

All candidates who are currently in receipt of Mark Time / Pay Protection should ensure they are familiar with the new policy on permanent and temporary promotion which can be found on the employee intranet.

Flexible working hours

Annual Leave

Annual leave is 25 days on appointment and will increase to 30 days after five years’ service.
